All employers are legally obliged to train an individual or group in health and safety.

Health and Safety Legislation is criminal law in the UK, and by law, all companies who employ 5 or more persons are obliged to have a written health and safety policy document, which extends their duty of care to employees and non-employees (for example, visitors, contractors and members of the public).

Section 40 of the Health & Safety at Work Act 1974 places the requirement on each company to prove that everything has been done to meet their duty of care and therefore the onus is on each company to prove their innocence in all aspects of health and safety.
