This course covers all aspects of construction contracts from the essential elements, which create a contract through to the provisions contained in the standard forms of construction contract in current use in the industry. The course includes tuition on the theory of contracts, supported with case studies to enable delegates to understand and deal with practical issues.
Aims & Objectives:
The course will enable delegates of all disciplines who need to use construction contracts to properly understand their content and use.
Learning Outcomes:
On completion of the course, delegates will:
Understand what constitutes a valid contract
Appreciate the reason for Standard Forms of Contract (SFoC)
Be aware of the more popular SFoC
Have the opportunity to reinforce their understanding by reference to case studies
Course Outline:
1. Essentials of a valid contract
Explanation of the criteria for a valid contract - Offer, Acceptance, Consideration, etc., the use of express and implied terms and the use of letters of intent.
2. Standard Forms of Contract
This section deals with the rights and obligations of the parties in respect of quality, programmes, payment, variations and dispute resolution under each of the following contracts:
ICE Conditions of Contract including the Design & Construct Contract
NEC3
JCT 2005 including the Design and Build Contract
PPC 2000
3. Case studies
Problems and worked solutions to enable delegates to properly understand and fully manage the procedures within construction contracts.
Mode of Delivery:
This course consists of lectures supported by interactive case studies.
